Dwarka Courts in Delhi: Cases, Jurisdiction and Lawyers

Someone is owed money and gets a legal notice. Someone purchased a property but is unable to take possession despite paying huge amounts of money. Someone has faced a dispute with another party over contractual agreement or has been issued a court notice for appearance at court in Delhi.

People can be uncertain about how to proceed in such situations and may start worrying about the loss of their hard earned money or not getting the due property or right they feel they are entitled to.

Dwarka Courts are a District level Court complex situated in Delhi that hears various civil, criminal, commercial, matrimonial and other cases which come under its purview.

Whether you are a business man, a professional or own property in Delhi you should know which court will entertain your case before filing or dealing with any legal dispute.

Some people think that since the party resides in Dwarka so their case will be heard at Dwarka Courts. Some may think that if I have sent a legal notice I am entitled to get my money back.

Not always will that be true.

There are certain laws that will decide your jurisdiction, evidence that needs to be provided, legality of the dues, time frame to file your case and remedy that you seek.

Dwarka Court lawyer can guide you about all these aspects before proceeding with your matter.

One should not look at only one side of any dispute.

A seller may say that the buyer refused to pay for their products. Buyer can argue that they didnt pay for some reason which the seller is not aware of.

Both parties would have to prove their claims with relevant documentation and evidence.

Same can be said if a person owns a property and wants to take possession of the same from an occupant. Just because someone owns a property doesnt mean that they can kick the occupant out right away.

Depending upon the scenario some acts and laws may need to be referred to.

So one should be cautious while filing for any remedy.

This article will discuss the importance of Dwarka Courts and what kind of cases are dealt here, what you need to keep in mind while dealing with any civil or criminal case in Dwarka court and what documents will be important during these proceedings.

Dwarka has been one of the busiest neighbourhoods in South West Delhi. With many business establishments running in the area. Schools, hospitals, offices, residential colonies and growing marketplace.

Surrounding localities like Palam, Janakpuri, Uttam Nagar, Najafgarh, Dabri, Bindapur etc fall under South West District which can have disputes related to various subjects.

Customer may not be paying his bills on time to a retail outlet. A landlord can have a dispute with the tenant about vacating the premises. There could be a disagreement between two business partners about who owes whom.

Not every problem has to go to court.

But some may need a legal remedy. Whether that is through mediation or filing of a lawsuit.

Dwarka Courts complex was set up on 6th September 2008 which hears all the courts which fall under South West District and few others under the IGI airport court.

It has civil courts, criminal courts and designated Commercial Courts among others.

Knowing what court to approach can help in the smooth running of your case.

Details of Dwarka Courts

What kinds of cases are heard in Dwarka Courts?

As mentioned above Dwarka court complex has various courts that hear different kinds of cases.

It depends upon what kind of case you are filing or against you and under which court does the case fall.

Civil Cases / Suits for Money Recovery

When we talk about civil cases it can relate to anything that pertains to any civil right. This can include recovery cases, suits regarding properties, injunction and many more.

If you supplied someone goods and are trying to get paid for the same you can file a suit against that person. If that person argues that he did not receive the goods he would have to prove the same as well.

Whatever happens would depend upon the court that hears the civil suit.

Just because someone sent you a recovery notice doesnt mean that your case has meritorious claims.

Criminal Cases and Bail Applications

If someone has committed an offence as per the law then a criminal case can be registered.

These cases can range from cheating, criminal breach of trust, forgery, criminal intimidation etc.

As of now different criminal laws may be applicable depending on when the incident took place.

There can be investigation, remand hearings and you can file for bail if you are accused of any crime.

You should contact a criminal lawyer in case you are accused of something. The person who files the complaint can also seek guidance about what to do further.

Cheque Bounce / Dishonor

Whether you lend money to someone or you are a business. You can file a cheque bounce complaint if a cheque is dishonored by a party.

There are certain conditions that need to be met under section 138 of NI Act 1881. If you are owed any amount towards a debt or liability.

The court will have to fall under the appropriate jurisdiction for you to file the complaint.

Property Cases

There are many cases related to properties. This can be to do with a sale of property or you owning property and someone else staying in it. You may want to file for eviction of that person.

The person occupying the property can have certain rights that you may have to contend with. This can also be related to rental and leases of a property.

Some matters can also come under the purview of Delhi Rent Control Act 1958.

Matrimonial Cases

Dwarka Court complex also has designated Family Courts which hear matrimonial and related cases.

This can include divorce, maintenance and any other legal cases that pertain to families.

Sometimes matrimonial cases also involve money but are of a personal nature so care needs to be taken when dealing with these.

Court hearings and mediation are not the same.

Motor Accident Claim Cases

If you suffer injury due to any motor accident you can file a compensation claim. This can also happen if you are disabled or pass away due to any such accident.

You can reach out to BK Singh Advocate if you would like to know which court to approach before filing any civil or commercial case.

Can You File Commercial Cases in Dwarka Courts?

Yes you can file a commercial case in Dwarka Courts. If it falls under the purview of the Commercial Courts located there and jurisdiction is satisfied.

Just because you run a business does not mean that the court will have jurisdiction. It depends on your case and how far back you can trace your business dealings.

If someone is not paying your business you can try and recover the amount by filing a case against them. But that person may have a few counter arguments for why they are not paying you.

Lets take for example. You run a packing business from Janakpuri and sell goods to a shop. They have ordered from you on a credit system and havent paid you the pending amount.

You can prove this with documents like bills, delivery challans, ledger and previous correspondences.

Your lawyer will analyze the situation and help you file a suit if required. But dont forget to consider the buyers point of view as well.

If you sell products to someone they may expect a certain quality or may be expecting you to deliver goods on time. Many contracts have such conditions in them. If you fail to fulfill those conditions someone may want to file a suit against you.

It depends upon the situation at hand and what evidence the court is given. If you lose a deal because your product was bad it doesnt mean that you are liable for that persons losses.

Two partners in a business may fight about who owes whom money or what they contributed to the company. There may be a registered agreement or just verbal understandings about what each of them is supposed to do in the company.

You may want to hire a lawyer to help you find the right court or remedy for such situation. If your company is a registered entity then some cases can go to specialized tribunals.

Someone may rent out property to a business or own a property for business use. If you dont pay your rent or the landlord terminates your lease then you may want to seek remedy for that as well.

Like all other legal disputes some commercial disputes can fall under Commercial Courts. Depending on your case.

Contracts can have arbitration clauses as well. Many times companies prefer to solve their disputes by appointing arbitrators instead of going to court. Arbitration has many advantages which can help you if your contract allows you to.

The Arbitration Act of 1996 deals with most of these matters. You should speak with a lawyer to see if your dispute can go to arbitration before approaching a Civil Court.

BK Singh Advocate can help you decide what will be best for your situation if you are looking for some legal counsel.

Documents needed for your Dwarka Court Case

As mentioned before having a good documentation can help you win your case. If you can provide your lawyer with all the relevant papers it can benefit you during the hearing of your case.

Sometimes people approach a lawyer and tell them everything that has happened but fail to provide the evidence.

Every case will require different documentation. Here are some common things that you will need for your legal case.

Emails and Digital Communication

Emails can play an important role in todays day and age. If you have digital bills or messages from a sender that can help you prove your case as well.

There are provisions in the Bharatiya Sakshya Adhiniyam 2023 which cover digital evidence for cases that come under it.

You should try to get hold of the original as much as possible.

What if I dont have all the documents?

Sometimes people dont have all the documents needed for their case. That doesnt mean that you cannot proceed with your case. But if you dont have a proper written agreement it could impact your case.

Do not try to create fake documentation that could hurt you in the long run.

If you feel that you need assistance you can reach out to Corporate Law Firm to see if your case is something we can help with.

How Will My Case Proceed in Dwarka Courts?

It depends on what type of case you are filing and what remedy you are seeking.

Lets look at some of the important stages that occur during a legal process.

Analyzing your Case

Your lawyer will have to understand what has happened between you and the other party. What documentation is available to prove your case, is your case within limitation etc.

Once all this is analyzed you can decide what route you want to take to resolve the dispute.

If you are the defendant and have been served a notice you need to act quickly and file your reply at the court.

Filing your Suit

If your matter qualifies you can go ahead and file your case in the court of law. Once you have prepared your case and papers are submitted to the court. You will have to pay court fee and submit your petition with necessary affidavits.

Your case may be checked by the registry and returned to you in case of any error that needs to be rectified.

Just filing your suit doesnt guarantee that you will win.

Summon/Notice to Opposing Party

The court may send you or the other party a notice. Depending on what stage your case is at you may have to reply to the notice that has been served.

In commercial cases you may be required to reply to summons in a timely fashion.

Submitting Evidence

During a case the court can ask for documents to be produced by both parties. These documents may help them decide what is right for the scenario.

Witnesses may also be called and cross questioned. You may resolve your dispute through settlement or your case may have to be decided by the judge.

It depends on how your case is.

Verdict of the Court

If you are awarded a favourable judgement you can use it to seek recovery of your amount if required.

You may have to execute your decree to collect money if the other party doesnt honor the court order.

Just because you have won the case doesnt mean you can collect your money right away.

If you are unhappy with the verdict of the court you can appeal to a higher court of law. There are some things that cannot be appealed against or may take longer to do so.

Speak with a lawyer if you need to know your options.

BK Singh Advocate can assist you in knowing what you need to do once a court has passed an order that you may want to challenge.

What should you not do before going to Court?

As stated earlier sometimes we can do some things that can adversely affect our case.

Here are a few things you should avoid doing before you file your lawsuit.

Ignore Court Notice

If you have received any notice from the court or a legal notice it is better that you look into it as soon as possible. Different notices can have different impacts on your case so make sure you reply to it on time.

Approaching the Wrong Court

Always ensure that you are approaching the court that has jurisdiction over your case. If you file your matter in the wrong court your case can be objected to and delayed. Make sure that there isnt any tribunal that hears your kind of case.

File a Fake Criminal Case

Not all monetary disputes can be deemed as cheating. Make sure that you are well versed with the offence you are accusing someone for. If you accuse someone of cheating without merit you can land yourself in hot water.

Wait too long to Recover Your Money

Many people wait for someone to pay them. Sometimes months or years go by and they still dont know if their money will ever come. Keep an eye on your limitation to ensure you arent missing out on your due money.

Settle without Knowing What Youre Getting Into

Some people settle for lower amounts rather than fighting for the full amount. But make sure you know what you are agreeing to and how your settlement will work. If you have a written settlement its best to read through all of it before finalizing.

Corporate Law Firm can advise you about what you should do if you have a dispute with someone.
